What is happening at the HOA meeting on Tuesday?

 

  • HOA Members are voting to pass these HOA Bylaws 
  • If the ByLaws are passed, the HOA plans to file them with Greenville County.  This give the HOA more authority over our property and lives.
  • Only HOA members that have paid their dues of $50 are allowed to vote, but these Bylaws affect all homeowners in the Terra Community!  
  • Anyone is allowed to attend the meeting.  You do not have to be an HOA member.
  • According to the Spring 2021 Newsletter, only 30 of the approximately 107 homes in the Terra Community are members of the HOA.

Why did I not hear about voting on the HOA Bylaws?

  • News of the HOA meeting was only posted on the this PRIVATE Terra Community Facebook page on June 21st, 2021
  • If you aren't an approved member of the Facebook page and checking the page regularly, you would not know about the meeting
  • Seems like the minority of Terra Community Homeowners want to vote on the Bylaws without consent from the rest of the households.

Do we really need an HOA?

  • Taken from Page 17 of the ByLaws:  "Members will report unauthorized or questionable Covenant violations to the President and Chairperson of the Architect Review Committee."
  • Homeowners in this community already do an excellent job of maintaining their properties.  Do we need neighbors reporting each other so the HOA can assess fines, place a lien on your property, and potentially foreclose on your home?
  • Property values are up across the board.  More restrictions are not going to make the Terra Community a more desirable place to live.
  • Dues are only $50 now, but will only increase.  Many neighborhoods with HOAs are required to pay $1000+ per year in dues.


What is in the ByLaws?

  •   The Board is able to "collect membership dues or assessments."   the dollar amount of dues or assessments is up to the HOA Board to decide.
  •  allows the Board to "mediate, arbitrate or litigate any and all matters in accordance with the Covenants.” That basically means that the Board can sue homeowners.  Who pays tens of thousands for the attorney?  The answer is us.
  •  Indemnity Section of the Bylaws (page 11)  is asking to submit to the authority of the Board, pay for any mistakes made by the Board, and never hole the Board responsible for their actions.
  •  The Architectural Review Committee ("the ARC") has entirely too much power under the Bylaws.  Under the Bylaws (page 14), the Board approves litigation, and the ARC manages said litigation. Who are we suing, and for what?   Not mowing their yard correctly, not installing the correct mailbox, not removing their trash can from the front of their driveway in a timely fashion? The subdivision has been operating just fine since the 1970’s. The cost of litigation far outweighs any benefit that could come from suing a resident of Terra Pines.
